Welcome to the House of MizDragonfly ("MizDragonfly," "we," "us," or "our"). These Terms of Service govern your access to and use of mizdragonfly.com and mizdragonfly.ca (the "Platform"), including all curatorial acquisitions, concierge communications, and bespoke commissions.

By accessing our Platform or acquiring an archival artwork or jewelry piece, you agree to be bound by these Terms of Service, alongside our Privacy Policy, Shipping & Delivery Policy, and Exchanges & Returns Policy.

1. Intellectual Property & Artwork Rights

• Exclusive Ownership: All creative works, Digital Haute Couture compositions, original imagery, texts, branding motifs, and digital media displayed across the Platform remain the sole and exclusive intellectual property of the artist, MizDragonfly, protected under Canadian, United States, and international copyright and moral rights legislation.

• Collector Rights vs. Reproduction Rights: Acquisition of a limited-edition artwork, acrylic glass piece, or bespoke object grants the collector ownership of the single, physical physical artifact only. No copyright, licensing, reproduction, or commercial exploitation rights are transferred upon sale.

• Restricted Use: Works may not be mechanically reproduced, digitally scanned, distributed, televised for commercial broadcast, or adapted into derivative commercial products without a prior, formal licensing agreement executed in writing by MizDragonfly.

• Anti-Scraping & Generative Training Ban: Systematic scraping, extraction, data mining, or submission of any MizDragonfly visual assets, artwork imagery, or editorial prose into artificial intelligence models, machine-learning training sets, or unauthorized blockchain/NFT minting platforms is strictly prohibited.

2. Art Presentation & Visual Representation

We endeavor to display the chromatic fidelity, textures, and dimensional facets of our acrylic glass works and jewelry with absolute accuracy. However:

• Display Variations: Because calibrated computer displays, mobile screens, and ambient lighting differ from physical archival acrylic refractions, minor chromatic or luminous variations between digital previews and physical prints are natural facets of fine art production and do not constitute defects.

• Bespoke Craftsmanship: Fine art acrylic prints and curated jewelry pieces are assembled and hand-finished with meticulous precision. Slight variations in mounting, framing tolerance, or natural jewelry settings are hallmarks of bespoke craftsmanship.

3. Acquisitions, Edition Integrity & Refusal of Service

• Edition Authenticity: Limited-edition works are strictly numbered and tracked within the studio archive. We reserve the right to verify collector identity prior to dispatch to preserve provenance integrity.

• Order Discretion: We reserve the right to limit, decline, or cancel acquisitions placed through the Platform if we suspect speculative mass purchasing, unauthorized reseller activities, fraud, or intentional breach of our collector policies.

• Pricing & Availability: Artwork valuations, series releases, and jewelry pricing are subject to adjustment without prior notice based on edition depletion and institutional secondary market dynamics.

4. Bespoke Production & Final Sale Terms

As stipulated in our Exchanges & Returns Policy, fine art prints, acrylic glass pieces, and custom large-format editions are custom-fabricated to order. Once an acquisition is submitted and enters the archival fabrication queue, it cannot be cancelled, altered, or returned for a refund.

Eligible jewelry pieces remain subject to the 7-day inspection window and strict tamper-evident security seal conditions outlined in our return protocols.

5. Prohibited Conduct

While visiting our Platform, you agree not to:

• Use our creative catalog, artist likeness, or brand trademarks for any unlawful, deceptive, or defamatory purpose.

• Reverse-engineer, circumvent, or compromise the technical infrastructure, encryption protocols, or payment gateways safeguarding the site.

• Post or transmit malicious software, automated scrapers, or abusive communications through our curatorial concierge desk.

6. Limitation of Liability & Warranties

Except as explicitly outlined in our studio transit insurance protocols, all digital services and Platform access are provided on an "as-is" and "as-available" basis. In no event shall MizDragonfly, its studio affiliates, or gallery partners be liable for indirect, incidental, or punitive damages arising from the use of the Platform or the transit of artworks beyond the stated replacement terms under our transit insurance coverage.

7. Governing Law & Jurisdiction

These Terms of Service, along with all artwork acquisition contracts, shall be governed by, construed, and enforced in accordance with the federal laws of Canada and the applicable provincial laws of Ontario, without regard to conflict of law principles.
